These Terms of Use and Sale (the “Terms” or “Agreement”) govern your access to and use of this website (the “Site”), which is owned and operated by Green Company S.A. (the “Operator”, “we”, “us”, or “our”).

By accessing, browsing, registering on, or using the Site, or by placing an order through the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

1.2. These Terms apply to (i) your use of the Site, (ii) any purchases, reservations, deposits, or requests made through or in connection with the Site, and (iii) the relationship between visitors, customers, and the Operator.

1.3. By using the Site, you agree to be bound by these Terms and any additional terms disclosed at checkout, in an order confirmation, or in a separate sales agreement.

1.4. Any purchases, reservations, and any account access (if provided) are personal to you and non-transferable, unless we expressly agree otherwise in writing.

2. General Use of the Site

2.1. The Site may provide vehicle listings, specifications, pricing information, contact forms, purchasing or reservation options, and access to Products.

2.2. You agree to use the Site lawfully and not to (i) interfere with the Site’s operation, (ii) attempt to gain unauthorized access to systems or accounts, (iii) introduce malware or harmful code, or (iv) use automated means (including scraping) to extract data without our prior written consent.

2.3. Information may be collected automatically or voluntarily when interacting with the Site, as described in the Privacy Policy available on the Site.

3. Registration (If Applicable)

3.1. If registration or account creation is required to access certain Products or services, you must provide accurate, complete, and up-to-date information and promptly update any changes.

3.2. Registration is optional unless it is specifically required for a particular Product or service.

4.4. We are not responsible for delays, interruptions, or failures caused by events beyond our reasonable control.

4.5. Technical issues may occur. To the maximum extent permitted by law, we are not responsible for losses resulting from such issues, including data loss or failed transmissions.

4.6. The Site and all Products are provided on an “as is” and “as available” basis, without warranties of any kind, except where required by mandatory law.

4.7. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, exemplary, or consequential damages arising from or related to the use of the Site or Products.

6. Vehicle and Product Information Disclaimer

6.1. Vehicle listings, specifications, features, images, prices, availability, mileage, and other information displayed on the Site are provided for general informational purposes only and may be subject to change.

6.2. Images may be illustrative and may not reflect the exact configuration, condition, or optional equipment of a specific vehicle. For used vehicles, normal wear and tear may be present.

6.3. To the extent permitted by law, we do not warrant that descriptions or other Content are complete, current, or error-free. Where an error materially affects your order, your remedies are limited to those available under applicable law and Sections 11 and 12.

6.4. Nothing in these Terms limits any mandatory warranties, legal guarantees of conformity, or consumer rights that cannot be excluded under applicable law.

7. Limitation of Liability

7.1. To the fullest extent permitted by law, the Operator is not liable for:

  • loss of profits, revenue, business, goodwill, or data;
  • indirect, incidental, or consequential damages;
  • errors, delays, or inaccuracies in the Site or any service; or
  • interruptions caused by external conditions or third-party systems.

7.2. Where liability cannot be excluded and is established in connection with a purchased Product, our total liability shall not exceed the amount paid for that specific Product, except where mandatory law provides otherwise (including, where applicable, for death, personal injury, fraud, or gross negligence).

9.1. If you have an account, you must maintain the confidentiality of your login credentials and are responsible for all activities that occur under your account.

10. Force Majeure

10.1. The Operator is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, war, government actions, labor disputes, supply chain disruptions, network outages, pandemics, emergencies, or failures of third-party providers.

11. Purchasing Terms

11.1. Purchases or reservations made through or related to the Site may include vehicles, accessories, spare parts, digital products, online content, subscriptions, and services.

11.2. Unless stated otherwise, prices displayed on the Site include applicable taxes. Additional costs (such as delivery, registration, documentation, or administrative fees) may apply and will be disclosed before order completion where required by law.

11.3. Prices, Products, promotions, and availability may change without prior notice, to the extent permitted by law.

11.4. Placing an order may constitute an offer to purchase. An order is accepted only when we confirm acceptance (e.g., by order confirmation, execution of a separate vehicle sale agreement, or delivery/hand-over), as applicable.

11.5. We may refuse, cancel, or limit quantities of any order where permitted by law, including for suspected fraud, pricing or description errors, or lack of availability.

11.6. Payment may be processed on the Site or via external systems. You must provide accurate billing, identification (where required), and contact information.

11.7. Delivery and hand-over:

  • Digital products are delivered electronically.
  • Physical goods are shipped or made available for collection as specified at checkout or in the relevant agreement. Delivery times are estimates unless expressly stated otherwise.
  • Vehicles may require additional steps (e.g., identity verification, documentation, registration, inspection, financing approval, or appointment scheduling). Any specific vehicle delivery/hand-over conditions will be communicated during the purchasing process or in a separate agreement.

11.8. Risk of loss for physical goods transfers to the customer once the item is handed to the carrier, unless otherwise required by law. For vehicles, risk and title transfer may be governed by a separate sales agreement and applicable law.

11.9. If a Product becomes unavailable after purchase, you will be notified and, where required, offered a refund or an alternative solution in accordance with applicable law.

12. Cancellation, Returns, and Refund Policy

12.1. Cancellations, returns, withdrawals, and refunds are handled in accordance with applicable consumer protection laws and any specific terms presented at checkout or in a separate agreement (including, where applicable, a vehicle sale agreement).

12.2. Where no specific legal requirements apply, the following general terms apply:

Digital Products
Cancellation is allowed within 14 days provided the digital product has not been accessed, downloaded, or used, and to the extent permitted by law.

Physical Goods (Non-vehicle)
Cancellation is allowed within 14 days of receiving the item, provided it is unused, in its original condition, and returned with all original packaging and accessories.
Return shipping may be the customer’s responsibility unless otherwise required by law.
Defective or incorrect goods will be repaired, replaced, or refunded in accordance with applicable legal obligations.

Services
Cancellation is allowed within 14 days unless the service has already begun or been completed, subject to applicable law.

Vehicles (if purchased or reserved online)
Any cancellation, withdrawal, return, refund, and treatment of deposits for vehicles may be subject to (i) mandatory law, and (ii) any separate written agreement governing the vehicle transaction. Where a deposit is taken to reserve a vehicle, the conditions under which it is refundable (or non-refundable) will be disclosed during the reservation/purchase process, subject to mandatory law.

12.3. Refunds will be issued using the original payment method unless otherwise required by law. Processing times may vary depending on banks and payment providers.

13. Customer Responsibilities

You agree to:

  • provide accurate and updated personal and payment information;
  • ensure you meet any legal requirements for purchasing or registering a vehicle in your jurisdiction;
  • ensure device compatibility for accessing digital content;
  • inspect delivered physical goods promptly and report issues within a reasonable time;
  • use and maintain Products (including vehicles) in accordance with applicable instructions, safety guidance, and legal requirements; and
  • report any account-related issues promptly (if an account exists).

14. Termination

To the extent permitted by law, we may suspend or terminate access to the Site, suspend accounts, or cancel orders under the following circumstances:

  • these Terms are violated;
  • false, misleading, or incomplete information is provided;
  • fraud, misuse, abuse, or unlawful activity is suspected;
  • the Privacy Policy is violated; or
  • we are required to do so to comply with law or a lawful request by authorities.

15. Governing Law and Jurisdiction

These Terms are governed by the laws applicable in the jurisdiction where the Operator is established, unless otherwise required by mandatory law (including applicable consumer protection rules).

Any disputes shall be submitted to the competent courts of that jurisdiction, unless mandatory law provides you with rights to bring proceedings in another forum.

16. Miscellaneous

16.1. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

16.2. We may assign or transfer our rights and obligations under these Terms to third parties, to the extent permitted by law. Your rights under mandatory consumer protection law are not affected.

16.3. These Terms, together with any additional terms referenced herein (including the Privacy Policy and any applicable sales or checkout terms), constitute the entire agreement between you and the Operator regarding the Site.
